The agreement
These terms are a contract between you and Surf Apps, LLC, which operates Add Captions. By creating an account or using the service, you accept them. If you're accepting on behalf of a company, you're confirming you're allowed to.
If you don't agree with something here, don't use the service — and if it's the sort of thing we could fix, tell us, because we do read those emails.
Your account
You need an account to export videos. You must be at least 13, give us a real email address, and keep your password to yourself. Everything that happens under your account is your responsibility.
One account is one person. Sharing a login with a team isn't allowed — not because we're precious about it, but because support becomes impossible when we can't tell who did what. There is no team plan yet; if you need one, email us and we'll work something out.
Tell us right away if you think someone else has got into your account.
What you can do
With an active subscription you can caption and export as many videos as your plan allows, for personal or commercial use, including client work. You don't owe us credit or attribution, and we claim no share of anything you earn.
Caption styles you build are yours. You can use them anywhere, including outside our product.
What you can't do
- Upload content you don't have the rights to caption.
- Upload anything illegal, including material that sexualises minors, incites violence, or infringes someone else's copyright.
- Upload pornography or sexually explicit material. Nudity that is incidental to a news, medical, educational, or artistic video is fine; content made for adult entertainment is not, whoever appears in it and whoever holds the rights.
- Resell, white-label, or wrap the service in your own product without a written agreement from us.
- Scrape the site, or run automated abuse of the free plan. There is no public API — if you want one, ask, rather than building against the endpoints the app uses.
- Reverse-engineer the service, or try to get at other users' files.
- Use the service to build a competing captions product.
We can suspend an account that's doing any of the above. For clear-cut abuse we act immediately; for everything else we'll email you first and give you a chance to explain.
Your content
Your videos, audio, and transcripts stay yours. We claim no ownership over them.
You grant us a narrow, revocable licence to store, process, transcode, and transmit your content — only as far as it takes to deliver the service you asked for. That licence ends when you delete the content. We do not use your content to train models, and we do not show it to anyone else.
You're responsible for having the rights to whatever you upload, including music beds and footage you didn't shoot.
Our content
The app, the site, our name, the wordmark, and the built-in caption styles are ours. You may use screenshots of the product in reviews, tutorials, and press. Everything else needs permission.
Plans, billing, and renewals
Free accounts can caption and preview one video, up to 5 minutes long, without paying. Exporting requires a subscription.
| PLAN | PRICE | WHAT YOU GET |
|---|---|---|
| Free | $0 | Caption and preview one video, up to 5 minutes. No exporting. |
| Pro monthly | $5 / month | Unlimited videos and exports up to 4K, no watermark, every style |
| Pro yearly | $50 / year | Same as monthly, for the price of ten months |
Subscriptions renew automatically on the same day each period until you cancel. We charge the card on file through Stripe. Prices are in US dollars and exclude VAT or sales tax where it applies.
Cancel any time from Settings → Billing. Cancellation stops the next charge; your plan keeps working until the end of the period you already paid for. We don't hide the cancel button and we don't ask you to email us to leave.
If a payment fails, we retry it a few times over the following couple of weeks and email you each time. After that the account drops to free — your projects stay, exports stop.
We may change prices. Existing subscribers keep their price for at least 12 months from the change, and we'll email 30 days before anything takes effect.
Refunds
If the product didn't do what we said it does, email us within 30 days of the charge and we'll refund it. No form, no interrogation.
We don't generally refund periods you used and were happy with, or renewals you forgot to cancel more than 30 days ago — but ask anyway; we've said yes plenty of times.
EU and UK consumers also have a 14-day statutory right of withdrawal, which sits underneath the 30 days above rather than replacing it. Starting an export inside those 14 days means asking us to begin immediately, which ends the statutory right for the part already delivered — the 30-day refund still stands.
Availability and support
We work hard to keep the service up and we'll tell you by email if something goes badly wrong, but we don't publish an uptime figure and we don't offer a contractual SLA. At five dollars a month, promising four nines would be a number rather than a commitment.
Support runs by email and from the Help & support panel inside the app, Monday to Friday, usually answered within one business day. Reports made from the panel get a reference number so you and we can find them again; there's no phone line and there is no chatbot.
Occasionally we take the service down for maintenance. Where we can plan it, we announce it at least 48 hours ahead.
Termination
You can close your account whenever you like, from Settings. Closing it deletes your projects and files permanently, and we can't get them back.
We can terminate an account that breaks these terms, or where we're legally required to. Except for serious abuse, we'll give you 30 days' notice and a way to export your work first.
Disclaimers
Automatic transcription is very good and is not perfect. Accuracy depends on audio quality, accents, background noise, and terminology. We don't warrant that captions will be error-free, and we recommend proofreading anything that matters — including anything you're relying on for legal accessibility compliance.
Except where the law says otherwise, the service is provided "as is", without warranties of any kind.
Limitation of liability
To the maximum extent the law allows, our total liability to you for any claim is limited to what you paid us in the 12 months before the claim arose. We are not liable for lost profits, lost content, or indirect or consequential damage.
Nothing here limits liability for fraud, death, or personal injury caused by our negligence, or any other liability that can't legally be excluded. If you're a consumer, your statutory rights are unaffected.
Changes
We improve the service constantly, so features come and go. If we remove something you depend on, we'll tell you in advance and, where it's reasonable, offer a way out.
When we change these terms materially, we'll email every account holder at least 30 days before it takes effect. Carrying on using the service after that date means you accept the new version.
Governing law
These terms are governed by the laws of the State of Delaware, and the state and federal courts sitting in Delaware have jurisdiction. If you're a consumer, you can also bring a claim in the courts of the country you live in, and you keep the protections of your local law — nothing here takes those away.
Before anyone files anything, email [email protected]. Almost everything gets solved that way.
